Second Amended and Restated Ground Lease with Balboa Bay Club Ventures, LLC for the Tidelands Property Located at 1221 West Coast Highway
Recommendation
a) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; and
b) Authorize the Mayor and City Clerk to execute the Second Amended and Restated Ground Lease by and between the City of Newport Beach and Balboa Bay Club Ventures, LLC, for the tidelands property located at 1221 West Coast Highway, in a form substantially similar to the agreement prepared by the City Attorney’s Office.
