Resolution No. 2026-91: Appeal of Action Confirming Surrender of Five Crowns Restaurant Limited Term Permit (PA2023-0202)

Recommendation

a)                     Conduct a de novo public hearing;

b)                     Find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. Additionally, this action is categorically exempt from the California Environmental Quality Act pursuant to Section 15321 under Class 21 (Enforcement Actions by Regulatory Agencies) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3 which exempts actions by regulatory agencies to revoke or terminate a permit or land use entitlements; and

c)                     Adopt Resolution No. 2026-91: A Resolution of the City Council of the City of Newport Beach, California, Denying an Appeal and Upholding the Planning Commission’s Decision Confirming Voluntary Surrender of a Limited Term Permit to Allow a Temporary Outdoor Dining Area with Live Entertainment Located at 3801 East Coast Highway (PA2023-0202) and Confirming Resolution No. 2025-18 Presents No Live Controversy.
